Among the many bills that are presented by Kenyan parliamentarians at each round of elections, there have been witty, visionary, foresighted but also many questionable, if not absurd. For this reason, most of them (as is also the case in Italy and in almost all the democracies of the Planet) are trashed.
We hope that this is also the case with the proposal arrived at the National Assembly in Nairobi by the Member of Parliament Moses Injendi, elected in the district of Malava.
The proposal calls for the amendment of a section of the Kenyan law on information and communications of 2019.
"The Commission may, upon request and upon payment of a prescribed fee, grant a licence authorising any person to create a social media platform for communication purposes," the proposal states.
In the intention of Injendi, which will be discussed shortly by the Parliament, the administrator of a group in Facebook or WhatsApp will also have to store all the data of users of the platform and submit them to the authorities when requested. He will also have to make sure and take responsibility for the fact that the members of the groups are of age.
"Anyone who contravenes the provisions of this section is liable to a fine not exceeding Ksh. 200,000 or with imprisonment not exceeding one year," the bill states.
In the same proposal, fines of up to KEs. 500,000 and sentences of up to two years in prison are also demanded for those who publish degrading or intimidating content online, including content that is prejudicial to race, sex, ethnicity, nationality, religion, political affiliation, language, ability or appearance.
In addition, the publication of information on social media that is deemed unjust, inaccurate and partial under the terms of a court will also entail the risk of imprisonment or fines. If the bill is passed, Kenyans on social media platforms such as Facebook will have to notify the Communications Authority before creating groups and will have to report existing ones if they reside in Kenya.
Administrators of such groups will also have to approve members and content according to the law.
