A definitive ruling that can create an historical precedent.
The African Court of Human Rights dismissed the Kenyan appeal against the ruling in favor of the ethnic minority of the Ogiek, a small Indigenous tribe of the Mau Forest to which the land had been removed with environmental motives and which had appealed to the Maximum competent continental body for human rights issues.
In reality, after the expropriation, little and nothing has been done to protect those lands possessed by the Ogiek that they could not make them who are hunters and farmers and still live according to their secular traditions. At least settlements and building have been installed there.
This ruling, besides restoring land and dignity to a people of many who still resist extreme civilization, is a precedent for all the other small ethnicities and tribes of Kenya, as long as the Government of Kenya does not decide to ignore it, challenging the African Court which would surely turn to the International Court of Strasbourg.
Now also the Mijikenda, the ethnic group of nine tribes living on the Kenya coast, can try to encamp rights on its sacred forests and historical areas such as Kayafungo (near Mariakani), Mepoho Site (in Kaloleni, where there is The sacred tree of the prophetic giriama, today reduced to corn field and landfill) and the nine Kaya (places of worship and prayer) of which one is seriously threatened by mining excavations.
